The Pay-TV Law and the maturing of Brazilian Animation in Historietas Assombradas

Abstract

This article investigates how the Pay-TV Law (12,485/2011) reconfigured the field of Brazilian animation, creating tension between the artisanal-auteur and industrial logics. We take the trajectory of Historietas Assombradas (para crianças malcriadas) as an emblematic case of this creative negotiation. The objective is to understand how the creator's signature — marked by macabre humor, a unique aesthetic, and references to folklore — was reconfigured in the face of the narrative and technical demands of serialized production for an international channel (Cartoon Network). The methodology combines a comparative film analysis of the three stages of the work (short film, pilot, series) — focusing on the evolution of elements representative of its visual and narrative identity — with a historical perspective of Brazilian animation, drawing on theorists such as Antônio Moreno and Sérgio Nesteriuk. The results demonstrate that insertion into the industrial context did not suppress authorship but forced its reinvention, resulting in a synthesis in which the creator's signature coexists with world-building and character design conventions typical of commercial animation. It is concluded that the law functioned less as a standardizing market imposition and more as a catalyst for the maturation of the field, where authorship reinvents itself to survive and expand its reach.
